Үндэсний баялгийн сангийн анхдагч хуулийн төслийг 2024 оны дөрөвдүгээр сарын 3-нд Засгийн газраас УИХ-д өргөн барьсан. Маргааш нь УИХ-ын чуулганы нэгдсэн хуралдаанаар хэлэлцээд анхны хэлэлцүүлэгт бэлтгүүлэхээр ЭЗБХ-нд шилжүүлсэн. Тэгээд таг болчихоод байгаа юм.
Уг нь Үндэсний баялгийн сангийн хуулийг батлан гаргах хийгээд Үндэсний баялгийн сантай болох хэрэгцээ, шаардлага нэгэнт үүссэн гэдгийг хууль санаачлагчид УИХ-д танилцуулсан. Ингэхдээ “Сүүлийн 30 орчим жилийн хугацаанд Монгол Улсын нийгэм, эдийн засаг нь байгалийн баялаг, түүний дотор газрын хэвлийн баялаг, стратегийн ач холбогдол бүхий ашигт малтмалын ордын нөөц ашигласны үр өгөөжөөс бүрэн хараат явж ирсэн. Гэсэн хэдий ч байгалийн баялгийн орлогоос өнөө ба ирээдүйн иргэдэд тэгш хүртээх зарчмыг төдийлөн зохистой хэрэгжүүлж чадаагүй өнөөг хүрсэн. Харин 2019 оны арваннэгдүгээр сарын 14-нд Үндсэн хуулийн Зургадугаар зүйлийн 2-т оруулсан нэмэлт, өөрчлөлтөөр байгалийн баялаг, түүний дотор газрын хэвлийн баялгийг ашиглах суурь зарчим, нөхөн сэргээгдэхгүй эрдэс баялгаас бий болсон үр өгөөжийг өнөө ба хойч үеийн иргэн бүрд тэнцвэртэй хуваарилах үзэл санааны суурийг илүү тодорхой болгон баталгаажуулсан. Ингэснээр Үндэсний баялгийн сан хэмээх Үндсэн хуулийн шинэ ойлголт бий болж, түүнийг хэрхэн бүрдүүлэх, хуваарилах, удирдах болон эдгээртэй холбоотой бусад нарийвчилсан харилцааг зохицуулах зайлшгүй шаардлага бий болсон. Тэр дагуу энэ хуулийн төслийг боловсруулсан. Монгол Улсын Үндэсний баялгийн сангийн тухай хуулийн энэхүү анхдагч төсөл нь таван бүлэг, 16 зүйлээс бүрдэх юм байна.
Энэ хуулийн төсөл батлагдсанаар Үндэсний баялгийн сангаар дамжуулан байгалийн баялгийг ард түмний мэдэлд байх Үндсэн хуулийн суурь зарчим хангагдана. Хөгжлийн сангаар дамжуулан хөгжлийн төсөл, хөтөлбөрийг санхүүжүүлснээр олон тулгуурт эдийн засгийн урт хугацааны тогтвортой өсөлтийг хангах суурь бүтцийг бий болгож, түүний үр өгөөжийг одоо ба ирээдүй үеийн иргэн бүр тэгш хүртэх боломж бүрдэнэ. Хуримтлалын сангаар дамжуулан одоо үеийн иргэн бүрийн эрүүл мэнд, боловсрол, орон сууцны суурь хэрэгцээг хангах хөтөлбөрүүд хэрэгжүүлснээр иргэний эрүүл, аюулгүй орчинд амьдрах эрхийг нь баталгаажуулах нөхцөлийг бүрдүүлнэ. Ирээдүйн өв сангаар дамжуулан ирээдүй үеийн иргэн бүрд тэгш хүртэх хуримтлалыг бий болгоно. Ирээдүйн өв сангийн хуримтлалын зарим хэсгийг өндөр өгөөжтэй, эрсдэл багатай гадаад санхүүгийн хэрэгсэлд хөрөнгө оруулалт хийх, хөрөнгийн зах зээлээс өгөөж хүртэж, санг арвижуулах боломжийг бүрдүүлнэ” гэж Засгийн газар “тайлбарласан” байна.
Ерөнхий сайд Л.Оюун-Эрдэнэ ч УИХ-ын чуулганд Үндэсний баялгийн сангийн тухай хуулийн төслийг танилцуулахдаа “Үндсэн хуульд байгалийн баялаг ард түмний мэдэл, төрийн хамгаалалтад байна хэмээн хуульчилсан боловч нийт стратегийн 16 ордын долоо нь “Эрдэнэс Монгол”-ын харьяанд, мөн стратегийн нөөцөд бүртгүүлэхгүйн тулд нөөцийн суурь мэдээллийг нь өөрчилж, АМНАТ, татвараас нуугдсан их хэмжээний баялаг бүртгэлгүйгээр далд эдийн засгийг бүрдүүлэн оршиж байгааг УИХ удахгүй болох нийтийн сонсголоор ил тод болгоно гэдэгт итгэлтэй байна. Энэ үйл явц мөн л нийгмийг нэлээдгүй бухимдуулах боловч 30 жилийг зөвөөр дүгнэхийн тулд иргэд, олон нийт зайлшгүй үүнийг мэдэх ёстой.
Өнгөрсөн хугацаанд энэ бүлэглэлтэй мөргөлдсөн улстөрчид, нийгмийн зүтгэлтнүүд учир битүүлгээр амь насаа алдаж, эсвэл улс төрийн тавцангаас шахагдан зайлуулагдсаар ирснийг түүхэн баримтууд нотолно.
Ордон дотор хүч мөхөствөл олон нийтийн дэмжлэг авч тэмцлээ үргэлжлүүлнэ гэж Ерөнхий сайдаар томилогдсоныхоо дараа хэлж байсныг Та бүхэн санаж байгаа биз ээ.
МАНАН хэмээн томьёологдсон энэхүү системийг задлахын төлөө хатуу зогссон магадгүй сүүлчийн Засгийн газар ч байж магадгүйг нэрэлхэлгүй үнэнээр хэлэх нь зүйтэй гэж бодож байна. Шүүхийн шатанд бүлэглэлийн томилсон шүүгчдийн өмнө хүч мөхөстөж байгаагаа ч нуугаад яахав.
Монгол Улсын язгуур эрх ашгийн төлөө зарчмын шийдэл гаргах Үндэсний баялгийн сангийн тухай хуулийн батлагдах үйл явц хялбар биш, ард түмэн Та бүхнийг анхаарлаа хандуулж, хэн нь хаана байгааг нарийвчлан дүгнэхийг, энэ хууль батлагдахад Ерөнхий сайдад олон нийтийн дэмжлэг одоо л хэрэгтэй байгааг, нам харгалзалгүй суурь зарчим дээр нэгдэхийг ард түмнээсээ Ерөнхий сайдын хувьд хичээнгүйлэн хүсэж байна” гэж байсан юм.
Гэвч Үндэсний баялгийн сангийн хуулийг зогсоох далд үйл ажиллагаа сүүлийн үед эрчимтэй явагдаж байгаа бололтой. Өнгөрсөн долоо хоногийн сүүлчээр болсон МАН-ын удидах ажилтнуудын чуулганы үеэр Ерөнхий сайд Л.Оюун-Эрдэнэ намынхандаа хандаж нэлээд “сонирхолтой үг” хэлсэн байна. Тэрээр “Баялгийн сангийн хуулийг унагах гэсэн ажиллагаа нэлээд явж байна. Би Баялгийн сангийн хууль дээр эсрэг байр суурь барьсан гишүүдийг нэр дэвшүүлэхгүй шүү. Тэд олигархиудынхаа нам руу явж болно. Бид бол Социал демократууд” гэсэн байна. Тодруулж хэлбэл, Л.Оюун-Эрдэнэ “Үндэсний баялгийн сангийн хууль бол баялаг иргэн бүрд шууд хүртэх суурь зарчим. Үүнийг ажил хэрэг болгохын тулд стратегийн ордуудыг хууль бусаар хувьчилж авсан гэр бүлүүдтэй мөргөлдөнө. Манайх бол баялгийн тэгш бус байдлын эсрэг, нийт нийгмийн талд зогсох ёстой Социал демократ нам шүү. Баялгийн сангийн хууль дээр эсрэг байр суурьтай гишүүдийг би нэр дэвшүүлэхгүй гэдгээ хэлье.
